Regulation of alternative payment systems operated through FinTech platforms Abstract (ENG) The aim of this master thesis is to focus on payment systems, define alternative payment systems, comprehensively summarize the effective regulation in the Czech Republic and then critically evaluate the level of this regulation regarding future technological developments in this area. In the introductory parts of this master thesis the author focuses on the general definition of payment systems, the possibilities of their theoretical division. Different types are afterwards compared to each other and some pros and cons are listed. Subsequently, the author focused on practice-based payment systems in the Czech Republic, namely CERTIS and ABO, and then ones functioning at the European Union level, especially TARGET 2, EURO1, SEPA 1, SEPA 2 and RT1. The next section describes the payment system with settlement finality as an example of a traditional payment system and then discusses three potential alternatives that could be considered as alternative payment systems. These are mobile payments and mobile wallets related thereto, the system on which digital currencies are based, and finally electronic money systems. Pavel Martiník Supervisor: JUDr. Petr Kotáb, Ph.D. Regulation of payment services plays a key role in this era driven by escalating digitalization. The aim of this Thesis is to depict current challenges that this area of financial law faces and to propose a basis for regulation that can be implemented in the Czech Republic. The main topic of this Thesis is virtual currencies, more specifically Bitcoins and their status within the system of payment services regulations. After a short introduction, the first chapter of this Thesis describes theoretical background of payment services regulation, especially general and specific aims of legislation in this area of financial law, by addressing it in full context of private and public law. Besides that, it also briefly illustrates the history of payment services and money. The next chapter deals with current regulation that has been adopted in the Czech Republic. Cashless society

This thesis is aimed at cashless payments which have recently gained worldwide significance. Cash is being gradually phased-out by card transactions and mobile payments via non-bank provider of payment services. A question arises of what would happen if cash would disappear in its entirety and we would find ourselves in a "cashless society". This topic which at first glance appears to be utopian is the subject of this thesis. The first part compares the market of cashless payments in the Czech Republic and in northern Europe (which is amongst the most developed), in particular with regard to the use of cards and mobile payments. The second part is concerned with the phenomenon of shadow economy and the influence of cashless payments on its volume. Concrete recommendations for the Czech economy are also the part of this chapter. The final part hits the essence of the issue and deals with concrete pros and cons of going cashless. The chapter is systematically divided into three parts - security, cost-benefit analysis and legal aspects.

Electronic payment systems

This bachelor thesis analysis issue of electronic payment systems. It discusses their use for payments on the internet and sending funds via e-mail. The first part is devoted to the theoretical definition and legislation of the issuance of electronic money and activities of electronic money institutions. The main part of the work clearly focuses on the use of e-wallets, which is an integral part of electronic payment systems. E-wallet of electronic payment system Moneybookers is considered as an example. The greatest attention is devoted to security of e-wallets, the risk of their use for money laundering and measures that should be introduced. The competitive electronic payment systems are discussed in the last chapter. The aim of this thesis is to provide detailed information about this method of payment on the internet and to state what an e-wallet is, what are the possibilities of its use, whether it is safe and what do providers carry out in the case of an attempt of money laundering and other frauds.
